Did Kentucky Pass A Law for Mandatory Drug Tests for Welfare Recipients? (House Bill 208 / HB 208)

No, they didn’t.

It has only just been introduced and has yet to be voted on. An article published by The Huffington Post on January 18, 2011, “Kentucky Lawmaker: Drug Testing Welfare Recipients Would Save ‘Millions And Millions’,” describes the proposal of the bill (set forth by state representative Lonnie Napier (R-Lancaster) and cosponsored by House Speaker Greg Stumbo (D-Prestonsburg)), but does not describe the establishment of any law.

Although it sounds like a pretty good idea in theory, it may conflict with Unwarranted Search/Seizure constitutionality. Also, the proposal is only about instituting a random drug testing format, rather than a mandatory testing for every applicant (which might be prohibitively expensive).

If you looked this up before you posted your Facebook status declaring your agreement with such a law, after seeing some other dimwit post it without even bothering to look it up, congratulations.

  1. I ABSOLUTELY AGREE THAT ALL STATES SHOULD PASS A MANDATORY DRUG TEST EVERY 60 DAYS TO QUALITY FOR PUBLIC ASSISTANCE SUCH AS FOOD STAMPS, PUBLIC HOUSING, UNEMPLOYMENT, FAMILY’S FIRST AND SSI. I KNOW FOR A FACT THAT MANY OF THE FOOD STAMP RECEIPENTS SELL THE BALANCE ON THE CARD FOR CASH TO BUY DRUGS. OUR LOCAL HEALTH DEPARTMENTS COULD ADMINISTER THIS TEST AND SUSPEND BENEFITS IF THEY FAIL THE TEST. I ALSO THINK THAT THEY SHOULD SUSPEND ALL IRS PAYMENTS FOR UNEARNED INCOME. THINK OF THE MONEY SAVED.

    • Unwarranted search and seizure? that is ludicrous. Most jobs require random drug testing. That is only common sense. Something the government needs more of. I vote we make it mandatory for our lawmakers as well.

    • i agree they should do these tests but you have gone way too far.. not all people who are one welfare does drugs or sells there foodstamps to buy drugs..everyone i know who is on welfare needs there foodstamps to buy food not drugs..as far as taking irs payments for unearned income, thats rediculous.. you have to be rich to make a comment like this because obvious you dont care about the average person who needs that extra income at the end of the year.. maybe this person doesnt buy drugs but smokes marijuana on occasion to relax and unwind, like having a beer or a glass of wine, doesnt make them a bad person..doesnt mean there out there buying drugs or selling there foodstamps to buy those drugs..

    • Nobody said anything about looking up the law of every state. It’s a matter of looking up ONE THING before you post it to the world. It’s a shame that people who actually research their statements before they post them are called out as the freaks. Get lost.

  3. No! The state does not fund the food stamps program, My taxes do. Now if the state want to start funding these things and cut my taxes in half they can do what they want, but not until then, also ssi is federal funds for states to give to those who has never worked or didnt work enough. Now thats truely unearned income. But they say social security is unearned also even you paid into it all the years one worked, but if they call it earned income they would have to tax it. So No No No. I dont care if they spend every fs dollar or every social security dollar on it. IT’s their money they paid in, now if you want to take away what one has never put in the “free money” that’s different, If I was disable and I paid in ss before I became disable, that’s my money and I could do whatever the hell I want, If drugs was my thing. Lets do this all those who test posti for drugs has to work at that company with out pay for 10 yrs…that’s as stupdid as this so called law, but If they pass it, those who vote for it can kiss their vote good bye cause there are alot of drug users who can vote

  4. The lie that this would save tax $ is so big I don’t know how anyone can be so foolish to believe it. I worked as a caseworker for a long time. I know. They would have to hire more ppl to deal with the paperwork of this testing. Also, lets play this game & say a person “fails” (1st of all the tests are not accurate, look up facts yourself, many meds, foods give a false postive) if they fail, cps is called, (more $) the person will lose their job, could lose their home, & family. More homeless ppl, more foster care (more $) So will the ppl be offered help, rehab? NO> I guess homeless ppl, hungry ppl do well to get off drugs. Also, what about the damage to the kids in this? Also consider the drug testing takes away time from recipients work, school, each persons community service requirements to receive assistance, & kids. Also, most states are requiring clients/recipients PAY for the test. Really? I can’t afford food, but, I have to pay for a test? To continue if the kids are taken, when CPS is involved ppl have to go to court, (more $) they will be entitled to an atty (more $) they will have to be drug tested more to get the kids back, guess who pays for that? CPS will have to hire more ppl to do home visits. (more $) All of this just b/c our society has to believe that all ppl who get assistance are doing drugs. This sterotype is very ignorant and not true. I am no longer a caseworker, I became ill, & now I am disabled & live in gov’t housing, all around me are sick ppl, families w/ disabled children, ppl who were severely abused as children & really never had a chance, I see very few ppl doing drugs to living up to the sterotype I keep hearing about. This bill will not save $, or make gov’t smaller, and it is very humiliating and cruel.
